Who does the rule cover?
TDEC says the final rule applies to healthcare facilities that generate, accumulate, or otherwise handle hazardous waste pharmaceuticals, and to reverse distributors that manage prescription hazardous waste pharmaceuticals. It does not apply to non-pharmaceutical hazardous waste, or to hazardous waste pharmaceuticals at facilities that are not healthcare facilities or reverse distributors. What is banned from the sewer?
TDEC says the final rule explicitly prohibits discharges of hazardous waste pharmaceuticals into public sewer systems. Do not pour a hazardous waste pharmaceutical down a sink because a red-bag vendor is not scheduled that day.
How do returns differ from waste?
TDEC summarizes two paths. Prescription hazardous waste pharmaceuticals moving through reverse distribution are solid wastes at the healthcare facility. Non-prescription hazardous waste pharmaceuticals and other unsold retail items sent through reverse logistics are not wastes at the healthcare or retail facility if there is a reasonable expectation they will be lawfully used or reused, or reclaimed.
